TENANT’S RIGHTS

FACT:

A landlord cannot deny you a rental unit if

you refuse to pay rent with post-dated cheques.

FACT:

Any damage to the property that is done

by you or one of your guests you are responsible

whether or not it was an accident.

FACT:

A landlord cannot refuse to rent to you

on the basis of age, race, religion, marital status

colour, gender, or creed.

FACT:

Your landlord cannot raise your rent for

12 months after you have moved in. If they plan

to raise your rent, the landlord must give you a

minimum of ninety days notice in writing stating

how much it will go up and when you will have to

start paying the new amount.

FACT:

If rent is not paid on time, a landlord can

terminate your lease prematurely. You will have

fourteen days after notice to vacate the premises.

FACT:

The only reasons a landlord can evict you

for having a pet are as follows: Your pet causes

unnecessary damage, the pet acts aggressively

towards people, also your species or breed of the

animal is known to be dangerous.

FACT:

A landlord may not change the locks on

your door without your consent.

FACT:

A landlord cannot refuse to rent because

you’ve children or you receive public assistance.

FACT:

A landlord must give you written notice of

termination detailing the date of termination and

reasons.

How Long Does An Eviction Take?

It varies case by case, of course, but from the

time most tenants get their first notice to the point

when the sheriff comes to evict takes at least one

month or two, assuming the tenant responds to

all notices. The usual steps of an eviction are:

(1)

A landlord gives eviction notice.

(2)

If the

tenant doesn’t move the landlord issues a second

eviction notice through the court.

(3)

The tenant

then has the opportunity to challenge eviction in

court.

(4)

The court then rules for either the tenant

or the landlord.

(5)

If a landlord wins, the Sheriff

will post a final eviction notice and evicts tenants

at end of that notice period, usually ten days.
